Golden Chicken Ticket Contest

OFFICIAL CONTEST RULES

1. SPONSOR: The Golden Chicken Ticket Contest (the “Contest”) is sponsored by Mary Brown’s Inc., 100, Renfrew Drive, Markham, Ontario, L3R 9R6 (the “Sponsor”).

2. ELIGIBILITY: Open to legal residents of Canada, excluding Quebec, Prince Edward Island, the Yukon and Nunavut who are age of majority in their province or territory of residence. In each of the above, eligibility shall be with the exception of employees of the Sponsor, or its parent, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, partners, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production or distribution of Contest materials and those living in the same household. By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules. Entrants who do not comply with any of these Contest Rules are subject to disqualification by the Sponsor, in the Sponsor’s sole discretion. Not sponsored, endorsed, administered by or associated with Facebook or Instagram.

3. CONTEST DATES AND TIMES: The Contest begins on July 1, 2019 at 8:00 a.m. EST and ends on July 10, 2019 at 11:00 p.m. EST (“Contest End Date”) after which time this Contest will be closed and no further entries shall be accepted. The sole determinant of time for the purpose of receipt of a valid entry will be the Sponsor’s server(s).

4. HOW TO ENTER: You can enter this Contest and obtain one (1) Contest entry for doing all of the following:

  1. Visiting a Mary Brown’s restaurant in Canada, excluding Quebec, Prince Edward Island, the Yukon and Nunavut, and taking a photograph of yourself.
  2. Post your photograph on either (i) Facebook with the hashtag #GoldenChickenTicket in the comments section or send us your photograph via direct message; or (ii) on Instagram on your profile with the hashtag #GoldenChickenTicket.

All photographic entries into this Contest must be received by the Sponsor by July 10, 2019 at 11:00 p.m. EST and must comply with all of the Photo Submission Guidelines set out below. All entries must be complete and are subject to verification by the Sponsor, in its sole discretion.

Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter this Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple accounts, multiple e-mail or social media accounts, multiple social media handles, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entries that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of these Contest Rules are void. No correspondence will be entered into except potential winners. Proof of transmission (screenshots or captures, etc.) does not constitute proof of entry or receipt of an entry into this Contest.

Photo Submission Guidelines

All photographic entries are subject to the following rules:

  • Entrants grant the Sponsor an exclusive license to use their photo entries for any purpose including the administration of this Contest and in any advertising, marketing or publicity, without notice or compensation, as may be edited, modified or translated in the Sponsor’s sole discretion.
  • The Sponsor may determine, in its sole discretion, whether or not to accept any photo entry and whether it will use any entry for any purpose, including in any marketing or publicity.
  • Entries cannot be any of the following, all of which shall be determined by the Sponsor in its sole discretion:
    • Sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or describe any dangerous activity.
    • Promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that are unsafe or dangerous, or any particular political agenda or message.
    • Obscene or offensive, endorse any form of hate or hate group.
    • Defame, misrepresent or contain disparaging remarks about the Sponsor or their products or other people, products or companies.
    • Contain trademarks, logos or intellectual property or content owned by 3rd parties or advertise or promote any brand or product of any kind.
    • Contain copyrighted materials owned by 3rd parties.
    • Refer to the name of any person without permission from that person for you and the Sponsor to reproduce it.
    • Reproduce, whether by photograph or any other means, the image of any person without permission for you and the Sponsor to reproduce it.
    • Communicate messages inconsistent with the purpose of this Contest, as determined by the Sponsor in its sole discretion.

The Sponsor may require any entrant to obtain any 3rd party consent necessary for their entry, whether to satisfy intellectual property, privacy or any other laws, before accepting an entrant’s entry into this Contest or using an entrant’s essay submission for marketing, the administration of this Contest or any other purpose, any such consent(s) which may be required by the Sponsor being be the sole obligation and expense of the entrant.

5. CONTEST PRIZES:

There is one (1) prize available to be won as follows: (1) a trip for two to Newfoundland for Mary Brown’s 50th anniversary party in St. John’s (approximate retail value $4,000) (the “Prize”).

The Prize shall consist of the following: (1) economy class airfare for two (the winner and a travel companion) from the closest departure airport located to the winner to St. John’s Newfoundland; (2) hotel accommodation for two people for three (3) nights; and (3) two tickets to Mary Brown’s 50th anniversary party. Maximum Grand Prizes value: $4,000.

All travel and hotel accommodation shall be arranged by the Sponsor and will be subject to availability. The Prize does not include anything not specifically stated above.

The winner shall assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or use or redemption of the Prize. The Prize must be accepted as awarded and has no cash value. Neither the Prize, nor any portion thereof, can be combined with any other discounts, promotions or special offers. The Sponsor reserves the right to substitute an alternate prize of equal or greater value if the Prize is unavailable at the time of award.

Prize award: The Prize winner will be contacted by the Sponsor after winning by direct message through the social media platform on which they entered.

6. ODDS OF WINNING: The odds of winning the Prize will depend on the number of eligible entries received before the Contest End Date.

7. WINNER SELECTION AND CONFIRMATION: The winner will be chosen by random draw by the Sponsor, located at 100 Renfrew Drive, Markham, Ontario, L3R 9R6, Markham, Ontario on July 12, 2019 at 11:00 a.m. EST.

The Prize winner will be notified on July 12, 2019. Up to three attempts will be made on July 12, 2019 to contact the winner. Any winner that cannot be contacted will forfeit the Prize and another potential winner will be chosen by way of random draw from all eligible entries received. The winner must provide signed and completed copies of the Sponsor’s Winner Release and Companion Release to the Sponsor by July 19th, 2019, 2019 and e-mailed to: contest@marybrowns.com.

The potential winner of this Contest will be declared by the Sponsor to be the winner if they meet all of the eligibility criteria set out in these Contest Rules, in the sole discretion of the Sponsor. If any potential winner does not meet all of the Contest eligibility criteria, in the sole discretion of the Sponsor, he/she will be disqualified and will not receive the Prize.

Disputes regarding identity of entrant: If the identity of an entrant is disputed, the entry will be deemed to have been submitted by the Authorized Account Holder (the individual assigned to the e-mail or social media account associated with the entry). Each entrant may be required to provide proof that he/she is the Authorized Account Holder associated with an entry, which may be determined by the Sponsor in its sole discretion.

8. SKILL-TESTING QUESTION: Skill-testing question required.

9. RELEASE AND INDEMNIFICATION: The winner must sign the Sponsor’s Declaration of Eligibility and Liability/Publicity Release forms to: (i) confirm compliance with the Contest Rules; (ii) agree to accept their prize as awarded; (iii) release, discharge and hold harmless the Sponsor, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, Facebook, Instagram and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of their entry by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or a prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of an entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of a prize as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur in connection with any claim or demand by any third party, including any 3rd party referred to or depicted in any entry, or as a result of any non-compliance by an entrant with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize and the use of the Entry by Sponsor. The winner must also have their travel companion sign and complete the Sponsor’s companion release form.

The Sponsor is not responsible for: (i) incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Winner Release or Travel Companion Release forms; (iv) injury or damage to the entrant’s computer or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of a prize, including any travel related thereto and the use of their entry by Sponsor; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.

10. OTHER CONDITIONS: The Sponsor reserves the right to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, the Sponsor reserves the right to cancel the Contest and conduct a random draw from all previously received eligible entries received by the Contest End Date and to substitute prizes of equal or greater value.

Publicity and entrant information: By participating in the Contest, entrants consent to the use of their full name, city, province, e-mail address, postal code, telephone number, social media handles, comments, image and photograph, whether on videotape, photograph or any other means, and their entries, as may be edited, modified or translated in any way in the Sponsor’s sole discretion for the administration of this Contest or any publicity carried out by the Sponsor or any of its marketing partners without further notice or compensation. Entrants agree to provide the Sponsor with an exclusive license to use their photographic entries for any purpose, as may be edited or modified by the Sponsor, including, but not limited to, for any marketing or promotional purposes and to waive any moral rights that may be associated with their photograph entries.

Law: This Contest is void where prohibited by law and subject to all applicable Canadian federal, provincial, municipal and local laws. This Contest shall be governed exclusively by the laws of the province of Ontario, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Markham, Ontario.

Rule amendments: The Sponsor reserves the right, in its sole discretion to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.

Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsor is strictly prohibited.

  1. Visiting a Mary Brown’s restaurant in Canada, excluding Quebec, Prince Edward Island, the Yukon and Nunavut, and obtaining a Contest entry card with a unique code when you purchase any meal, combo or feast. Not available for any other purchase.
  2. Visiting the Mary Brown 50th anniversary website and entering your unique Contest entry card entry code at: marybrowns.com/winnerwinner

No Purchase Required Entry

Entrants can also enter this Contest by mailing a self-addressed, postage paid envelope to: Attention: Mary Brown’s Winner Winner Contest, 3163 Winston Churchill Blvd., PO Box 26030 Mississauga, Ontario L5L 5S0, and the Sponsor will mail the entrant a Contest entry card.

  2. Re-tweeting a Sponsor’s Contest related tweet using the hashtag #clickndinner. Only one tweet is required for an additional entry. Multiple tweets will not increase your chances of winning a prize. Any entrant found to be using multiple Twitter accounts to enter this Contest will be ineligible to win any prize.

There are 121,480 prizes available to be won as follows: (1) ten (10) Grand Prize trips for two to Newfoundland for Mary Brown’s 50th anniversary party (approximate retail value (ARV) $4,000 each); (2) five (5) pairs of tickets to Mary Brown’s 50th anniversary party and one (1) night accommodation for Newfoundland entrants (ARV $2,800 each); (3) 121,465 instant win prizes as follows (APRs based on Ontario prices): (a) 36,415 Small Taters (APR $2.99 each); (b) 36,414 Sweet Mary’s (APR $1.99 each); (c) 24,268 Big Mary’s (APR $6.99 each); (d) 24,268 2 Piece + Small Taters (APR $7.49 each); and (e) 100 $50 Mary Brown’s gift cards.

Regional allocation of prizes: (1) Grand Prize: British Columbia: 1; Alberta, and Northwest Territories and Saskatchewan: 3; Manitoba: 1; Ontario: 3; New Brunswick: 1; and Nova Scotia: 1; (2) Newfoundland winners (tickets to Mary Brown’s 50th anniversary party): 5.

Each Grand Prize shall consist of the following: (1) economy class airfare for two (the winner and a travel companion) from the closest departure airport located to each winner to St. John’s Newfoundland; (2) standard hotel accommodation for two people for three (3) nights; (3) two admission to a tour activity (4) some meals and (5) two tickets to Mary Brown’s 50th anniversary party. 6. ODDS OF WINNING: (1) Instant Win and Gift Card Prizes: odds of winning 1 in 7; (2) Grand Prizes: odds of winning will depend on the number of eligible entrants to enter this Contest in each region before the Contest End Date.

Grand Prize winners and Newfoundland Mary Brown’s 50th anniversary ticket winners will be notified on June 11, 2019. Up to three attempts will be made on June 11, 2019 to contact each winner. Winners will be contacted by their e-mail address provided upon entry into this Contest. Any winner that cannot be contacted will forfeit their prize and another potential winner will be chosen by way of random draw. All Grand Prize winners and Newfoundland winners of tickets to Mary Brown’s 50th anniversary party must provide signed and completed copies of the Sponsor’s Winner Release and Companion Release to the Sponsor by June 30th 2019 and e-mailed to: contest@marybrowns.com

Rule amendments: The Sponsor reserves the right, in its sole discretion to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.

Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsor is strictly prohibited.
